Got this phone for Christmas and its fab. I love the camera is superb and i just want to say its a better phone than my last phone. I WOULD ADVISE YOU TO BUY THIS PHONE!!!

Received this phone yesterday and so far Im delighted, great looking loads of extras in the box,(USB cable,software, phone cleaning pad, soft cover, earphones, and remote for the MP3 player). I would recommend this to anyone. e2save gave me a great deal.

But be aware that the game has changed with these cashback deals. Only be prepared to take them on if you do not mind a battle with E2Save or other CPW offshoots. However much you stick to their unreasonable terms you may well having your claim and depending whether it is a 'clearance' contract, all subsequent claims rejected. If you are not prepared to get tough at that point, personally I would not bother getting involved with this sort of deal at all if I were you.

However, if you are prepared to treat it all as a game and it does not wind you up too much, just make sure you have a copy of the terms and conditions when you order, stick to them and where they are ambiguous take the route which appears most obvious from the wording eg although they might claim until they are blue in the face that although they asked for the '4th monthly bill' you really should have sent in the 3rd or 5th or whatever, they really would get laughed out of court. So be prepared to go legal.

Another point to note is that although CPW do have companies registered as E2Save Ltd etc, they use E2Save, OneStopPhoneShop and ThePhoneSpot.Com as trading names for The Carphone Warehouse Ltd and your contract is with the latter company. All legal correspondence should be addressed to their Legal Department at their registered office which is 1 Portal Way, London W3 6RS.

Finally whilst you may resent paying out £4.25 a go ie about twenty quid during the contract, for delivering your claims by Special Delivery, I think it is a false economy not to send claims this way. After all, do you really want to give them any chance of wriggling out of paying you anything up to £500 on the grounds of non delivery or late delivery.

Just remember that it has been calculated that 55-60% of cashback claims need to be rejected for them to break even, let alone make a profit. Just go into it with your eyes open.

What you say is fair enough Pentangle - though I think when you mention "clearance" deals where one failed claim negates all future claims, you mean the "price-match" deals they did not long ago. Recently E2Save do seem to have dropped those appalling terms, and these clearance deals give an auto-cashback varying from £80-£135 (no need to claim) plus 4 claims required at 6,8,10,12 months. Confusing claim details though... it says

Instalment 1 - You will need to claim 6 months from connection and you have 30 days from this date to submit your claim. Send us your claim form and monthly bill showing your name, address, mobile number and tariff you are connected to. (This bill must be no older than 28 days when we receive it and have no balance brought forward.)

i.e. if you purchased on the 1st of January 2007, you need to send in the bill that is dated around the 1st July 2007, and you will have until the 30th July 2007 to do so. This is 180 days (6 months) after connection.
I'm trying to work out how you'd have 30 days in which to send in a bill which must be no more than 28 days old when they receive it - it's generally a week old before it reaches me. And if, as their example says, your bill was dated 1st July, you'd NOT have until 30th July to do so (send it in). But I think anomalies and ambiguities such as these would be in a customers favour if it did ever reach the courts, they demonstrate incompetence, fail to make the terms clear.
Note that the terms don't say "6th,8th,10th,12th Bill". O2 issue a bill immediately. I have an O2 contract with CPW that called for 4th, 8th, 12th bills to be submitted. I checked with them, and was told to ignore the first bill - they didn't count that one. "So the 4th Bill isn't the 4th bill, the 5th bill is the 4th bill?" "Yes, that's right" I checked twice more, just to be sure (and for fun!). Anyway, it worked, I've had 2 of the 3 cashbacks with no problem.

I'm not convinced about the need for Special Delivery. There was a time when RM failed to track bulk deliveries for recorded but that seems OK now, and whilst tracking does not always appear online, I've always found that RM can supply Proof of Delivery when I call them. Incidentally, I sent in 2 claims to CPW recently, one I almost forgot, was very close to time so that went SD and the other went Recorded. Both arrived next day, both showed up online next day as delivered, were processed together and chqs arrived same day. SD is good, but is there any advantage now?

Speaking of CPW, there was a post recently about Carphonewarehouseclearance.com who are new(?) Rpoints partners. They are NOT CPW, but another subsidiary. And their clearance offers and terms are identical to E2Save as far as I can see. But whereas purchases from CPW give 2500 points, carphonewarehouseclearance give 1500 points (100 less than E2S). I'm reasonably OK buying from CPW... at least if things go pearshaped I can go into the local store and shout at someone. Is it just my impression or are CPW actually better than their online-only off-shoots, do you think? (Down, TopCats, don't rise to it! Smile)

Lastly, I'd be interested to know where your figure of 55-60% of cashback rejections comes from? Is that rejections or failures? There must be a fair percentage of "natural wastage" when people forget to claim, haven't kept up their contract payments or have downgraded, etc - without any nefarious activity by the dealer. That's a figure I'd very much like to know. to put things in perspective.

Yes, superchef, you can cancel the handset support (and the phone insurance too). I think cancelling the direct debits they set up is sufficient. And itemised billing too if you wish, as that's extra from O2. You're subscribed to all three automatically.

Hi LinBaden,

Yes, it is the price match terms which negate all future claims if they reject one. I am not qualified to judge whether CPW's terms are just put together in an incompetent fashion, or whether there is anything deliberate in the ambiguity. There is ample evidence that even their Customer Services staff do not understand their policies on cashback.

eg on the price match terms the time scale is stated as 30 days from the date on the invoice which is near to 120 days from connection. CS appear to believe it is 30 days after the 120 days of connection and the invoice must be no more than 28 days old. They also seem to be rejecting claims which are not submitted within 30 days after 120 days from the date the order was entered by the customer on the internet which may be quite different from the connection date. These obviously all produce different time slots.

The main point I am making is that your claim may well be rejected unjustifiably because they are using a different interpretation to you. There is no point going into these contracts unless you are prepared to fight your corner. If you are, as you say LinBaden, you would expect to win a legal battle (not that there will ever be one as they are always likely to pay up when they get a writ) because of the ambiguity. I am currently in my third fight with them in 18 months and I will win this one as I have the previous two.

You may well be right about recorded delivery as against special delivery. However, RD costs £1 and SD £4.25, so for the extra £10-£15 over the contract to get cash back of anything up to £500 back I would regard it as a reasonable investment for the certainty of delivery date.

The 55-60% was calculated by someone who knew what commission these companies get back from the networks as against the 100% cashbacks plus phones in these deals. You are right in that it includes people who just do not bother to claim (yes they exist!). However, even taking this into account there is a lot of pressure on these companies and they will reject claims where they can, not always with justification.

You will receive a letter from E2save re VIP support which shows your payment details. Also gives website address www.tmtivip.com where you can log on with the reference number in the letter and cancel your account.
You will receive an email confirmation.
